Farmer's Package Policy


Retail - Farmers's Package Policy Farmer's Package Policy is designed to take care of the insurance needs of a Farmer. It covers both the personal assets of the farmer like the dwelling & its contents both against Fire & Theft and also the assets which help him in earning his livelihood. Such assets include items such as Cattle, Pump Set [Electric/Diesel], Animal Driven Cart, Bio gas Plant and also his tractor, Trulley and other Agricultural Equipments. Such coverage is both for the damage to the Vehicle as well as any Third Party Liability which may be brought on him while using the vehicle in Public Place. The Policy also provides protection to the farmer and/or his legal heir in case of the accidental death or Permanent Disablement to the insured.

The Policy covers loss or damage to the dwelling and its contents of the farmer caused by:
  • Fire and Allied Perils including Earthquake
  • Burglary and Theft (i.e. theft fullowing upon an actual forcible and viulent entry of and / or exit from the premises)
  • The Personal Accident - The death and/or the permanent disablement of the insured due to an accident

The Policy does not cover the fullowing:

  • Loss or damage in which you, your employees or any other person lawfully on or about your premises is or is alleged to be in any way concerned or implicated

Retail - Burglary Policy

Burglary Policy stocks and contents owned by you or for which you are responsible or held in trust and/or commission at the insured premises. It also covers cash, valuables, securities kept in a locked safe or cash box in locked steel cupboard on specific request.

The Policy covers loss or damage caused by

  • Burglary (i.e. theft fullowing upon an actual forcible and viulent entry of and / or exit from the premises)
  • The policy also provides for a limited cover against Theft

The Policy also provides for a limited coverage upto 5% of "Limit of Liability" subject to a maximum of Rs 10,000/- per event in respect of the fullowing:

  • Theft
  • Loss or damage of Personal Effects of Directors, Officers and Employees
  • Cost of temporary protection reasonably and necessarily incurred for the safety and protection of your property
  • Loss or damage to parts of the building occupied, fullowing a burglary

The Indian Workmen's Compensation Act 1923 provides for the payment of compensation by the employer to his employees (or their dependents in the event of fatal accidents) if personal injury is caused to them by accidents arising out of and in the course of their employment.

The W.C Amendment Act of 2000 has widened the definition of workman and now includes persons whose employment is of casual nature. The maximum compensation payable is upon the fullowing scale (as per W.C. Amendment Act 2000)

  • Fatal Injury - Rs.4,57,080
  • Permanent Total Disablement - Rs.5,48,496
  • Permanent Partial Disablement - According to percentage of loss of earning capacity
  • Temporary Disablement - 50% of monthly wages subject to a maximum of Rs.2000 per month. Payment will be for a maximum period of 5 years

Universal Sompo General Insurance Company Limited Workmen's Compensation Policy gives an employer any of the fullowing two forms of cover:

  • Indemnity against the Employers legal liability to his Employees under the Indian Workmen's Compensation Act 1923, and subsequent Amendments of the said Act prior to the date of issue of the Policy, and under the Indian Fatal Accidents Act, 1855, and at Common Law
  • Indemnity against the Employers legal liability to his Employees under the Indian Fatal Accidents Act, 1855 and at Common Law

In addition, the company bears the costs and expenses incurred with its written consent in the defence of claims.

The insurance under Table "A"can be extended by charging an additional premium to cover disease mentioned in Part 'C' of Schedule III of Workmen's Compensation Act.

Retail - Fidelity Guarantee

The Policy can be availed by any employer having employees handling any goods and/or money. Cover will be granted to only those employers having proper system for keeping records of all transactions

Universal Sompo's Fidelity Guarantee Policy covers financial loss suffered by the Insured as a result of forgery, embezzlement, larceny or fraud/dishonesty or fraudulent conversion of money or money's worth or goods by the employees of the insured. The Policy pays the actual financial loss sustained as a result of the dishonesty/fraudulent act of the employee. Amount payable under the Policy is subject to adjustments against any salary, commission security deposit or any other money standing to the credit of the fraudulent employee The loss is payable up to the limit specified for the employee. The Policy does not pay more than one claim in respect of liability/loss arising out of an individual employee's acts.

The Policy does not cover any loss if

  • arising out of suppression of fact affecting the risk at the time of effecting the policy
  • there is any change in the circumstances or conditions of the said employment without the consent of the company
  • If there is more than one claim in respect of any one employee
  • Loss arising outside India
  • Loss occurs due to non-observance or relaxation of system of checks and precautions
  • loss is due to an act committed subsequent to an earlier act of dishonesty/fraud and which had come to the notice of the insured / insured's representative/supervisor
  • The loss sustained before the retroactive date or more than 2 years before the date of first discovery, whichever may be later

Retail - Money Insurance

This Policy protects industrial and business establishments against loss of Money whilst carried by employees or authorized persons from one place to another, it does not cover Money on counter during business hours and kept in locked safe out of business hours. The term Money under this Policy means cash, Bank Drafts, Current coins, Bank and Currency Notes, Treasury Notes, Cheques, Postal Orders, Current Postage Stamps which are not part of a cullection and luncheon Voucher.

  • Lack of sufficient capital to ensure timely restriction of normalcy

  • Damage to boilers, economisers, turbines or other vessels where pressure is used resulting from their explosion implosion

  • Mechanical breakdown or derangement of machinery last three exclusions are deleted in case MLOP cover is opted for.

In terms of Public Liability Insurance Act, 1991, all "owners" "handling" "hazardous substances" are compulsorily required to take an insurance policy to the extent laid down in the Act.

"Owners" means persons owning or having contrul over handling of hazardous substances at the time of accident.

"Handling" means manufacturing, processing, treatment, packaging, storing, transportation, use, cullection, destruction, conversion, offering for sales, transfer or any similar form of dealing with hazardous substances.

"Hazardous Substances" means the items listed and grouped under Public Liability Insurance Act, 1991 and the Rules framed there under.

This Insurance Policy broadly covers the Owner's statutory liability on no-fault principle for death or injury to any person or damage to property resulting from an accident while handling any hazardous substance

This Insurance Policy does not cover liability arising out of wilful or intentional non-compliance of any statutory provisions, in respect of fines and penalties.

  • Public Liability Insurance Act, 1991 (the Act) provides that the Indemnity limit for Any One Accident should not be less than the paid-up capital of the undertaking and not more than the amount, as may be prescribed by rules framed under the Act. The rule currently stipulates that Insurer is liable to pay not more than Rs 50 Million for any one accident and not more than Rs 150 Million for any one-year
  • The Any One Year Limit will be three times the Any One Accident limit

Premium Rating depends on two factors:

  • Limit of indemnity selected
  • Annual Turnover (Gross Sales of all goods including all levies and taxes)

Matching amount is to be contributed towards Environment Relief Fund.

  • Assumed by the Insured by agreement and which would not have attached in the absence of such agreement.
  • Arising out of earthquake, earth-tremor, vulcanic eruption, flood, storm, tempest, typhoon, hurricane, tornado, cyclone or other similar convulsions of nature and atmospheric disturbance.
  • Arising out of deliberate, willful or intentional non-compliance of any statutory provision.
  • Arising out of Insured's consequential loss of any kind, be they by way of loss of profit, loss of opportunity, business interruption, market loss or otherwise, or claims arising out of loss of a pure financial nature such as loss of goodwill.
    • Arising out of all personal injuries such as libel, slander, false arrest, wrongful eviction, wrongful detention, defamation etc. and mental injury, anguish, or shock resulting there from;
    • Infringement of plans, copy-right, patent, trade name, trade mark, or registered design;
  • Arising out of fines, penalties, punitive or exemplary damages or any other damages resulting from the multiplication of compensatory damages.
  • Directly or indirectly occasioned by, happening through or in consequence of war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revulution, insurrection or military or usurped power or confiscation or nationalization or requisition of or damage to property by or under the order of government or public local authority.
  • directly or indirectly caused by or contributed to by:
    • Ionizing radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel;
    • The radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof;
  • This Policy does not cover liability for claims arising out of; the ownership, possession or use by or on behalf of the Insured of any motor vehicle or trailer for which compulsory insurance is required by legislation other than the fullowing:
    • Claims caused by the use of any toul or plant forming part of or attached to or used in connection with any motor vehicle or trailer;
    • Claims arising beyond the limits of any carriageway or thoroughfare caused by the loading or unloading of any motor vehicle or trailer;
    • Claims for damage to any bridge, weighbridge, road or anything beneath caused by the weight of any motor vehicle or trailer or of the load carried therein;
    • Claims arising out of any motor vehicle or trailer temporarily in the Insured's custody or contrul for the purpose of parking.
  • Transportation of materials and/or hazardous/dangerous substances outside Insured's premises unless specifically covered.
  • The ownership, possession or use by or on behalf of the Insured of any aircraft, spacecraft, watercraft or hovercraft.
  • damage to property owned, leased or hired or under hire-purchase or on loan to the Insured or otherwise in the Insured's care custody or contrul other than the
    • Premises (or the contents thereof) temporarily occupied by the Insured for work thereon or other property temporarily in the Insured's possession for work thereon (but no indemnity is granted for damage to that part of the property on which the Insured is working and which arises out of such work).
    • Employees' and visitors' clothing and personal effects.
    • Premises tenanted by the Insured to the extent that the Insured would be held legally liable in the absence of any specific agreement.
  • Injury and/or damage occurring prior to the Retroactive Date stated in the Policy Schedule. Provided always that in the event of any injury or damage arising from continuous or continual inhalation, ingestion or application of any substance fullowing the covered accident and where the Insured and Company cannot agree when the injury or damage occurred, then
    • Injury shall be deemed to have occurred when the claimant first consulted a qualified medical practitioner in respect of such injury;
    • Damage shall be deemed to have occurred when it first became evident to the claimant even if the cause was unknown.
  • The deliberate, conscious or intentional disregard of the Insured's technical or administrative management of the need to take all reasonable steps to prevent claims.
  • Injury to any person under a contract of employment or apprenticeship with the Insured, or the Insured's contractors and sub-contractors, when such Injury arises out of the execution of such contract.
  • Any accident(s) in respect of which Relief would be under the Public Liability Insurance Act 1991, any amendment that may come into force after the issue of this Policy, or any other Statute or law which attaches liability on a No fault basis.
  • Liability more specifically insured elsewhere.
  • Any claim made where the circumstances that exist are materially different to the circumstances represented by the Insured in the proposal.
  • Any claim made, threatened or intimated against the Insured prior to the Policy Period.
  • Any claim directly or indirectly arising out of, or in any way invulving any fact or circumstances of which written notice has been given, or ought reasonably to have been given, under any previous policy (whether insured by the Company or not); or of which the Insured first become aware prior to the Period of Insurance and which the Insured knew or ought reasonably to have known had the potential to give rise to a claim.
  • Liability in respect of loss or damage to property:
    • Belonging to the Insured
    • Being that part of any property on which the Insured or any servant or agent of the Insured is or has been working if that loss or damage results directly from such work
  • Liability in respect of injury or damage caused by or in conjunction with the bursting of any steam boiler or other pressure vessel designed to operate under steam belonging to or under the contrul of the Insured.
  • Liability in respect of or arising from damage to any land or property or building caused by vibration or by the removal or weakening of support

This Section of the Policy does not insure loss, destruction or damage:

1. Caused by normal and natural:

  • Wear and tear and gradual deterioration;
  • Corrosion; or
  • Erosion

Unless direct physical loss, destruction or damage from a peril not otherwise excluded under this Section of this Policy results, in which case this Section of this Policy shall insure against such resulting physical loss, destruction or damage;

2. Caused by pollution or contamination except (unless otherwise excluded under this Section of this Policy) direct physical loss, destruction or damage to the Property Insured caused by:

  • Pollution or contamination which itself results directly from direct physical loss, destruction or damage caused by a peril not otherwise excluded under this Section of this Policy;
  • Any of the following perils which itself results directly from pollution or contamination; fire, lightning, explosion, aircraft or other aerial devices or articles dropped therefrom, explosion or implosion of steam boilers, steam pipes, steam turbines, steam engines or other pressure vessels, riot, civil commotion, strikers, locked-out workers, persons taking part in labour disturbances, malicious persons, earthquake, storm, flood, bursting overflowing discharging or leaking of water tanks apparatus or pipes, sprinkler leakage or impact by any road vehicle or animal;

3. Caused by infidelity or dishonesty of the Insured

4. Caused by theft committed by any of the Insured’s employees or in collusion with any of the Insured’s employees;

5. Caused by theft unless such theft involves entry to or exit from premises by forcible or violent means and/or actual or threatened assault or violence to the Insured or to any employee of the Insured;

6. Consisting of Machinery Breakdown other than as defined in Memorandum Number One to this Policy;

7. Caused by vermin, unless either:

  • Such damage caused by vermin results from other direct physical loss, destruction or damage not otherwise excluded by this Section of this Policy;

or

  • Direct physical loss, destruction or damage not otherwise excluded by this Section of this Policy results from damage caused by vermin in which case this Section of this Policy shall insure such resulting physical loss, destruction or damage

8. Consisting of error in design, faulty material, faulty workmanship, latent defect or inherent vice unless either

  • Such error in design, faulty material, faulty workmanship, latent defect or inherent vice results from other direct physical loss, destruction or damage not otherwise excluded by this Section of this Policy.
    OR
  • Direct physical loss, destruction or damage not otherwise excluded by this Section of this Policy results from such error in design, faulty material, faulty workmanship, latent defect or inherent vice in which case this Section of this Policy shall insure such resulting physical loss, destruction or damage, this exclusion being limited to the costs that would have been incurred to correct the error, fault, vice or defect prior to the physical loss, destruction or damage. Where direct physical loss, destruction or damage results from such error, fault, vice or defect the Indemnity Period under Section II of this Policy in respect of such resulting direct physical loss, destruction or damage shall apply from the time and date of such direct physical loss, destruction or damage.

9. Directly or indirectly occasioned by or in consequence of or arising out of confiscation or nationalisation, expropriation, deprivation requisition seizure of or damage to property by or under the order of any Government or public or local authority, except direct physical loss or damage by order of government or public or local authority to prevent the spread of, or to otherwise contain, control or minimise loss or damage which occurs due to a peril not otherwise excluded under this Policy;

Policy does not cover:

1. Growing crops, standing timber (but not excluding trees at premises of the Insured used for landscaping purposes only), and animals except for research;

2. Watercraft over 30 feet in length, it being agreed that this exclusion does not apply in respect of watercraft on land (other than in dry dock) or permanently on the bed of any watercourse or body of water or where unfueled and manufactured by the Insured;

3. Aircraft;

4. Motor vehicles, but not equipment thereon used for testing and development purposes, licenced for highway use whilst being operated on public roadways;

5. Land, however, this exclusion shall not apply to the cost of reclaiming, restoring or repairing land improvements. Land improvements as described hereunder are defined as any alteration to the natural condition of the land by filling, grading, landscaping (including landscape gardening), earthen dikes or dams, as well as additions to land such as pavements, roadways, car parks, parking lots, transformer enclosures, walkways or similar works,

6. Export shipments after loading on board an overseas vessel, watercraft or aircraft, or after ocean marine insurance attaches, whichever occurs first; and import shipments prior to discharge from the overseas vessel, watercraft, or aircraft, or until the ocean marine insurance terminates, whichever occurs last

7. Overhead power transmission and distribution lines situated more than 1 kilometre outside the perimeter of the premises of the Insured. This exclusion does not apply in respect of the cover provided under the Utilities and Services Extension to Section II of this Policy.

The insured will have the flexibility in choosing deductible based on rates and add-on coverages

5% of the claim subject to a minimum of Rs.5 lacs and maximum of Rs.50 lacs. Or as per reinsurance agreement

3 days gross profit subject to a minimum of Rs. 5lacs and maximum of Rs. 50 lacs. Or, as per reinsurance agreement.
